This Data Privacy Statement regulates the handling of the personal data of customers, registered users, interested parties and non-registered visitors of the websites of BENEO.

Collection and processing of personal data
When you visit our web site, our servers routinely store various data in an electronic “log file”. These data include e.g, the IP address from which you are accessing our site, the web page from which you are visiting us plus the date and duration of your visit. The data are used exclusively for security and statistical purposes and under no circumstances are any forwarded to third parties. This enables us to continuously improve our web site and to enhance its attractiveness, usefulness and content.

Basic principles
BENEO commits to protecting the private sphere of the visitors and users of the BENEO websites and to use their personal data exclusively according to relevant data protection law and this Data Privacy Statement.

The employees of BENEO shall be routinely obligated to maintaining data secrecy. The basis for this is found under the respective applicable statutory provisions such as the EU Data Protection Regulation (GDPR) and the German “Telekommunikation-Digitale-Dienste-Datenschutz-Gesetz” (TDDDG).

Collection and transmission of personal data within BENEO group
Your personal data collected via this website or by any other means will not be transmitted to any third parties other than the following legal entities of the BENEO group:

Use and divulgence of personal data and limitation of use
We collect and save personal data that you have voluntarily provided; for example, data that are submitted if you send us a message via a contact form, if you register for a download, if you participate in a survey, a contest or apply for a position. These data are used exclusively for the purpose identified and described.

Furthermore, personal data are only divulged to government institutions and authorities within the limits of mandatory regulations. Our employees and agencies are duty bound by us to respect the confidentiality of the data and strictly adhere to the stipulations of the European Data Protection Acts.

Server logs
For technical reasons, your data is processed on our web servers. This data is transmitted from the internet browser to our web server. The data is stored in server log files. The following data is stored there:

  • type and version of the browser used
  • operating system (User agent)
  • websites that linked to our site (referrer URL)
  • websites that have been visited
  • date and time of your visit
  • your Internet Protocol (IP) address
  • status codes
  • amount of data
  • user of htaccess

We have commissioned Microsoft Corporation, One Microsoft Way, Redmond, Washington 98052-6399, USA (hereinafter referred to as ‘Microsoft’) to host and technically provide our website. We have concluded the data processing agreement required under data protection law with Microsoft. According to this agreement, Microsoft undertakes to ensure the necessary protection of your data and to process it in accordance with the applicable data protection regulations exclusively on our behalf and in accordance with our instructions. This data is anonymized and stored separately from any other personal information, thereby making it impossible to connect it to any particular person. The data is used for security and statistical purposes, for technical maintenance or incident management in order to improve the quality of our website and of our services. Our legitimate interest lies in these purposes and is also the legal basis for the processing and storage of log files in accordance with Art. 6, para. 1 lit. f GDPR. IP addresses are usually anonymized after 7 days.

Cookies are small text files which are transferred from our websites, applications or services and stored on your device. We use cookies to help us provide you with a personalized service, and to help make our websites, applications and services better for you.

Our cookies may be session cookies (temporary cookies that identify and track users within our websites, applications or services which are deleted when you close your browser or leave your session in the application or service) or persistent cookies (cookies which enable our websites, applications or services to “remember” who you are and to remember your preferences within our websites, applications or services and which will stay on your computer or device after you close your browser or leave your session in the application or service).

We use the CookieScript service of the provider Objectis Ltd, Laisves st. 60, LT-05120 Vilnius, Lithuania (hereinafter referred to as ‘CookieScript’) on our website to provide our cookie banner. The system controls the use of third-party providers, technical measures and cookies via consent given or refused.

CookieScript processes the following data to provide and manage the CMP:

(1) your IP address
(2) further information about the browser used and the browser version,
(3) date and time of your visit to our website or your settings made via our cookie banner,
(4) the URL of the website accessed,
(5) an anonymous, random and encrypted key (ID),
(6) your given consent or individual privacy settings

and uses both the local storage on your device and the setting of cookies to store this information locally in your browser. To do this, your individual settings are stored in a cookie so that the settings made are taken into account the next time you visit our website.

The retention period is the length of time for which the data processed by the cookie banner is stored for the purpose of consent management. The consent data (consent given and consent withdrawn) is stored for four months. During this period, no re-consent is required unless new systems are introduced or if legal or regulatory requirements make it necessary to obtain re-consent. The purpose of data processing by CookieScript is to provide and manage the consent given by our website visitors in order to comply with data protection-compliant consent management. The use of CookieScript serves the purpose of providing proof of consent given and not given, as well as managing the individual data protection settings of our users. The processing is carried out for the purpose of obtaining the consent of the website visitor, providing options for revocation and objection, for providing evidence of the consent obtained (time of consent, end device used) and for identifying the user for the purpose of managing his or her individual data protection settings.

The use of a cookie banner and the management and storage of your consent to the processing of your personal data is based on Art. 6 para. 1 lit. f) GDPR. Our legitimate interest lies in the legally secure documentation and verifiability of consent as well as the control of, for example, analysis campaigns based on your consent through the use of specialised contract processors and the associated technical implementation.

The processing of data for the provision of a cookie banner is essential for the operation of the website. There is no right of objection on the part of the user as long as we have a legal obligation to obtain the user’s consent to certain data processing operations. 

Google Analytics and Tag Manager
This website uses Google Analytics, a web analytics service provided by Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Irland (“Google”). Google Analytics uses “cookies”, the information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will truncate/anonymize the last octet of the IP address for Member States of the European Union as well as for other parties to the Agreement on the European Economic Area. Only in exceptional cases, the full IP address is sent to and shortened by Google servers in the USA. On behalf of the website provider Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage to the website provider. Google will not associate your IP address with any other data held by Google.

The legal basis for the processing of personal data using cookies for statistical purposes is based on your consent in this regard via the cookie settings or our cookie banner Art. 6 para. 1 lit. a) GDPR. The setting of cookies is based on §25 Abs. 1 TDDDG. The information obtained through the use of Google Analytics is used in particular to better understand the use of the website and to improve its content, functionality and findability. We as website operators are using your data in order to improve our website, advertising and to personalize content.

Google Analytics collects data about your user behaviour, such as page views, interactions and your approximate geographical location. Technical information about your device and your internet service provider is also collected.

The data collected in this way is in turn used by Google to provide us with an evaluation of visits to our website and the usage activities there. This data can also be used to provide further services related to the use of our website and the use of the internet. Google states that it will not associate your IP address with any other data held by Google. In addition, Google provides further information under www.google.com/intl/de/policies/privacy/partners for you, for example, on how to prevent the use of data. In addition, Google offers under https://tools.google.com/dlpage/gaoptout?hl=de a so-called deactivation add-on in addition to further information. This add-on can be installed on the most popular browsers and offers you further control over the data that Google collects when you visit our website. The add-on informs Google Analytics’ JavaScript (ga.js) that no information about the website visit should be transmitted to Google Analytics. However, this does not prevent information from being transmitted to us or to other web analytics services we may use as detailed herein. This website uses Google Tag Manager, a service provided by Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (hereinafter ‘Google’). This service can be used to manage website tags. Google Tag Manager only implements tags and does not use cookies. The Google Tag Manager triggers tags that may in turn collect data. Each time the Google Tag Manager is accessed, a direct connection is established between your browser and a Google server (usually a Google server in the United States). Information about your visit and your IP address are processed on the Google server. The temporary storage of the IP address by the system is necessary to enable the Google Tag Manager to function.

We have entered into the agreement required under data protection law with Google. Pursuant to this agreement, Google undertakes to ensure the necessary protection of your data and to process it exclusively on our behalf in accordance with the applicable data protection regulations. The legal basis for the processing of personal data using Google Tag Manager is our legitimate interest in the efficient integration of additional services in accordance with Art. 6 (1) (f) GDPR.

Use of Pardot Analytics Pixel to analyze your usage behaviour

On our website we have integrated a pixel of the web analysis service Pardot Analytics, a service of Salesforce Inc, Salesforce Tower, 415 Mission Street, 3rd Floor, San Francisco, CA 94105, USA (hereinafter “Pardot Analytics”). Pardot Analytics uses cookies which are set via the pixel embedded on our website to analyze the user behaviour of our website visitors, provided that you have consented to the analysis via our consent banner. If you have been on a campaign website / landing page used by us, cookies for tracking by Pardot Analytics are placed on your respective end device used. If you visit our website and the cookie has not yet expired, Pardot Analytics can recognize that you have already visited one of our campaign websites or landing pages.

Cookies are text files that are stored on your computer or the terminal device you are using (tablet, smartphone, etc.) and enable an analysis of your use of our website (see “Privacy policy on the use of cookies”). You can find a list of the cookies used by Pardot Analytics Pixel, including their purpose and validity period, in our consent banner at any time. The cookies are set exclusively on the basis of your consent.

The information collected by the Pardot Analytics pixel is used to compile statistics. In doing so, we learn the total number of users who were on our campaign websites and were redirected to a page provided with a pixel from Pardot Analytics.

If you have consented to a group-wide use of your data (see also here under section “Processing of data within the Südzucker Group for targeted customer approach and presentation of products of the companies of the Südzucker Group”, Pardot Analytics enriches your existing profile in Salesforce Pardot with the information about the usage behaviour on our website in order to send you targeted offers and information about our products within the Südzucker Group.

The legal basis for the processing of personal data, i.e. the activation of the pixel as well as the setting and evaluation of information stored in marketing cookies, is based on your consent in this regard via our consent banner or the data protection settings Art. 6 para. 1 lit. a) DSGVO. The setting of the targeting cookies is carried out in accordance with § 25 para. 1 TDDDG.

The information obtained through the use of Pardot Analytics is used in particular to better understand the use of our website and our campaign websites / landing pages and to improve its content, functionality and findability. As the website operator, we have an interest in analyzing your user behaviour in order to improve both our offering and its performance. We use the information from Pardot Analytics to better tailor our communications to our customers’ needs.

The data is deleted as soon as it is no longer needed for our purposes or you have revoked your consent to the use of your data for analytics purposes via our privacy settings. Sessions are terminated after 30 minutes of no activity and campaigns after six months. The time limit for campaigns can be a maximum of two years. After that, all data and information collected will be deleted by the system.

You can revoke your consent given to us via our consent banner for the collection of your data by Pardot Analytics at any time for the future by deactivating the check mark under Cluster “Targeting” in our data protection settings. However, we would like to point out that in the event of deactivation or opt-out, you may not be able to use all functions of the website to their full extent.

Crazy Egg
We use the Crazy Egg web analysis service on our website, an offer from Crazy Egg, Inc., 16220 E. Ridgeview Lane, La Mirada CA 90638, USA (hereinafter “Crazy Egg”). By using Crazy Egg, we can track how you move around our website and what you have viewed or clicked on in each individual case. The tracked usage behaviour is subjected to a systemic and anonymous evaluation, i.e. the user affected by the evaluation is not identifiable. The selection of users whose behaviour is subject to evaluation is also subject to a random principle. By using Crazy Egg, we obtain valuable information to make our website faster and more customer friendly.

Crazy Egg uses so-called cookies, text files which are stored on your computer and which enable an analysis of your use of the website (see section “Privacy policy for using of Cookies”). A list of the cookies used by Crazy Egg can be found at any time in our cookie banner.

The following information is processed by Crazy Egg:

  • IP address in anonymised form (the IP address is anonymised by Crazy Egg at the time of collection)
  • websites seen and patterns of movement on these pages;
  • Number and position of clicks on links;
  • Browser type and version;
  • Screen size of the terminal used.

The information generated by the cookies or generated by Crazy Egg from the user is transmitted anonymously to and stored on Crazy Egg servers hosted in the USA.

We have concluded the agreement with Crazy Egg on order processing in accordance with Art. 28 GDPR in conjunction with the EU standard contract clauses, which is required under data protection law, in which Crazy Egg undertakes to protect the data of our users and to process them in accordance with the applicable data protection regulations. Crazy Egg uses the collected data exclusively on our behalf, for the purpose specified here. Crazy Egg will not use the data for any other purpose or pass it on to third parties. The data collected by Crazy Egg will not be stored together with other personal data of our website visitors.

We use Crazy Egg based on your consent given to us via our cookie banner (Art. 6 para. 1 s. 1 lit. a) GDPR):

a) to perform aggregated data analysis of user activity on our website,
b) to statistically record the use of our website and evaluate it for the purpose of optimising our offer for you,
c) for continuous improvement and management of our offer.

You can revoke your consent to data processing by Crazy Egg at any time in the future. By changing the selection in the cookie banner settings, you prevent Crazy Egg from carrying out the technical measures and from setting cookies by Crazy Egg. Alternatively, you can object to the processing of your data by Crazy Egg directly with the provider at http://www.crazyegg.com/opt-out or prevent the storage of cookies by means of an appropriate setting in your browser.

Ipify

We use the Ipify service (api.ipify.org) to optimise the aggregated access statistics for our website. This involves determining the public IP address of the requesting device and comparing it with an internal list of internal group IP addresses. This serves the purpose of excluding our own employees’ internal traffic from the general web analysis.

The processing is carried out on the basis of our legitimate interest in accordance with Article 6(1)(f) GDPR. Our legitimate interest lies in improving the informative value of our web statistics by excluding internal access and thus enabling a realistic analysis of external user behaviour.

The determined IP address is used exclusively for the immediate comparison and is not stored permanently. Further processing or disclosure to third parties does not take place.

Use of Taggrs

We use the Taggrs service (api.taggrs.io) to monitor the performance of our server-side tagging infrastructure and to optimise our web analysis. This involves data being processed by a server-side Google Tag Manager container.

The processing is carried out on the basis of our legitimate interest in accordance with Art. 6 para. 1 lit. f GDPR. Our legitimate interest lies in improving the stability and performance of our server-side tagging and optimising our web analytics.

What data is processed?

  • IP address
  • Location data (if available)
  • Device data (e.g. browser type, operating system)
  • Browsing behaviour (e.g. which pages have been accessed)

The IP address is processed by Taggrs, but not permanently stored. In addition, data transfer is carried out via the service provider Cloudflare, which processes the IP address to protect against attacks.

Use of Google Ads

We use the online advertising programme ‘Google Ads’ on our website, a service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (hereinafter ‘Google’). We use functions such as advertising, conversion tracking and remarketing.

A direct connection is established between your browser and a Google server through the built-in measures and your visit to our website. Google uses the connection to collect the following information: your browser type, your end devices, the website accessed and, for example, the effect of a Google ad and stores this in cookies, which are stored on your end device. Google makes it clear in its privacy policy that this information is processed. We have no influence on the data collected by Google and the data processing operations, nor are we aware of the full extent of the data collection, the purposes of the processing or the storage periods. We use Google Ads and the information generated in this way for a cost-benefit analysis and to optimise our Google ads. Google provides anonymised statistical evaluations for this purpose.

When you click on an ad placed by Google, a cookie for tracking Google Ads is stored on the end device you are using. Further information on cookies – in particular which cookies are set by Google in the context of the use of Google Ads, including information on the purpose and period of validity – can be found in the consent banner.

If you visit certain pages of our website and the cookie has not yet expired, we and Google can recognise that you have clicked on one of our ads and were redirected to this page.

The data collected by Google is provided to us in the form of aggregated statistics. This tells us the total number of users who clicked on your ad and were redirected to a page with Google Ads Tracking. We use this information to create and analyse conversion statistics and target group clusters. Please note that we do not provide Google with any data for the implementation of a target group cluster and that we do not perform any list matching.

If you are signed in to Google with your profile, Google can link the information obtained via the Google Ads cookies to your profile. For more information about data processing, please refer to Google’s privacy policy at https://policies.google.com/privacy?hl=de.

It is important for us to make our website attractive and to increase interaction with our visitors with the help of the service. We use our advertising and marketing services, in particular the use of Google Ads, for our conversion tracking and remarketing. Google Ads enables us to analyse the costs and benefits of ads that have been placed and to optimise our ad placement. The processing, i.e. the activation of tracking and the setting and evaluation of information stored in cookies, is carried out exclusively on the basis of your consent given via our consent banner for the setting of retargeting or advertising cookies (Art. 6 para. 1 lit. a DSGVO).

You can revoke or object to the use of Google Ads in the following ways:

(1) You can disable the storage of cookies by selecting the appropriate settings or setting your browser to notify you when cookies are set. To do this, you need to change the necessary settings in the browser menus Preferences or Options. We would like to point out that in this case some areas of our website may not work or may no longer work properly, i.e. only to a limited extent.

(2) You can disable or adjust the settings for personalised advertising by Google by contacting Google directly. If you have a Google account, you can view and edit your advertising settings or disable personalised advertising in your profile or account settings by going to ‘My Ads Centre’. In addition, we would like to point out that you can prevent an assignment to your profile by logging out of your respective Google profile before visiting the website and also by deleting the cookies used by Google.

LinkedIn
The controller has integrated components of the LinkedIn Corporation on this website. The operating company of LinkedIn is LinkedIn Corporation, 2029 Stierlin Court Mountain View, CA 94043, UNITED STATES. For privacy matters outside of the UNITED STATES LinkedIn Ireland, Privacy Policy Issues, Wilton Plaza, Wilton Place, Dublin 2, Ireland, is responsible.

With each call-up to one of the individual pages of this Internet site, which is operated by the controller and on which a LinkedIn component (LinkedIn plug-in) was integrated, the Internet browser on the information technology system of the data subject is automatically prompted to the download of a display of the corresponding LinkedIn component of LinkedIn. Further information about the LinkedIn plug-in may be accessed under https://developer.linkedin.com/plugins. The legal basis is Art. 6 Para. 1 lit. a) GDPR. Your consent can be given, for example, via the consent banner, where you can also revoke your consent. During the course of this technical procedure, LinkedIn gains knowledge of what specific sub-page of our website was visited by the data subject.

If the data subject is logged in at the same time on LinkedIn, LinkedIn detects with every call-up to our website by the data subject—and for the entire duration of their stay on our Internet site—which specific sub-page of our Internet page was visited by the data subject. This information is collected through the LinkedIn component and associated with the respective LinkedIn account of the data subject. If the data subject clicks on one of the LinkedIn buttons integrated on our website, then LinkedIn assigns this information to the personal LinkedIn user account of the data subject and stores the personal data.

LinkedIn receives information via the LinkedIn component that the data subject has visited our website, provided that the data subject is logged in at LinkedIn at the time of the call-up to our website. This occurs regardless of whether the person clicks on the LinkedIn button or not. If such a transmission of information to LinkedIn is not desirable for the data subject, then he or she may prevent this by logging off from their LinkedIn account before a call-up to our website is made.

LinkedIn provides under https://www.linkedin.com/psettings/guest-controls the possibility to unsubscribe from e-mail messages, SMS messages and targeted ads, as well as the ability to manage ad settings. LinkedIn also uses affiliates such as Eire, Google Analytics, BlueKai, DoubleClick, Nielsen, Comscore, Eloqua, and Lotame. Advertising and marketing service LinkedIn Insights Tag or tracking pixel

We use the online advertising programme “LinkedIn Campaign Manager” and, as part of the LinkedIn Campaign Manager, the Insight Tag or tracking pixel (hereinafter “LinkedIn Insights Tag” or “pixel”). The LinkedIn Insights Tag in the LinkedIn Campaign Manager is an analytics service provided by LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland (hereinafter “LinkedIn”). After you have given your consent via our cookie banner, we integrate a LinkedIn Insights Tag on our website using the Google Tag Manager and enable LinkedIn to evaluate your surfing behaviour and to personalize ads. If you click on an ad placed by us in LinkedIn, cookies for conversion tracking by LinkedIn are stored on your respective end device used.

The cookies set by the integration of the LinkedIn Insights Tag are described in our cookie banner under the cluster “Marketing” including the respective validity period.

If you visit our website and the cookie has not yet expired, LinkedIn can recognise that you clicked on the ad and were redirected to that page. Each LinkedIn Campaign Manager customer receives a different Tag. Thus, there is no way that cookies can be tracked across LinkedIn Campaign Manager clients’ websites.

The information collected using the LinkedIn Insights Tag is used to create conversion statistics. This tells clients the total number of users who clicked on their ad and were redirected to a page with a LinkedIn Insights Tag.

It is important for us to make our website attractive and to increase the interaction with our visitors using the service. We use our advertising and marketing services, in particular the use of the LinkedIn Insights Tag, for our conversion tracking and remarketing. With the help of the LinkedIn Insights Tag, a cost-benefit analysis of ads placed as well as the optimisation of our ad placement on LinkedIn is possible. The processing, i.e. the activation of the Insights Tag as well as the setting and evaluation of information stored in marketing cookies, takes place exclusively on the basis of your consent given in the cookie banner (Art. 6 para. 1 lit. a) GDPR).

• You can deactivate the storage of cookies through corresponding settings or set your browser so that you are notified as soon as cookies are set. If you register for our free newsletter, the data requested from you for this purpose, i.e. your email address and, optionally, your name and address, will be transmitted to us. At the same time, we store the IP address of the internet connection from which you access our website, as well as the date and time of your registration. As part of the further registration process, we will obtain your consent to receive the newsletter, describe the content specifically and refer you to this data protection declaration.
